The terms of use of this website shall be governed by and construed fully in accordance with the laws of Ireland. You and we agree to submit to the exclusive jurisdiction of the courts located in Ireland. If any provision(s) of the terms of use is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. It is our policy not to sell alcohol to anyone under the age of 18 years of age in accordance with the law. By placing an order with us, you are confirming you are over 18 years. Your order will only be fulfilled once you have completed the ID Verification, a link for which will be emailed to you. Failure to complete the ID verification process releases Cider Cellar from its obligation to fulfil the order. In the event that the ID Verification process has not been completed within 15 days of the date of purchase on the Website a full refund will be made to you.

It is our intention to have all products displayed on our website in stock. From time to time some items may be out of stock temporarily. In this case, you can leave your email and we will contact to you when the item has been re-stocked.

When you place an order with us by pressing the ‘Shop’ button on the purchasing page of this website you are making an offer to purchase product(s) from us. No contract exists between Cider Cellar and you at this point. The contract is only created when you have completed the ID Verification process and we send you an email confirming receipt of your order and our acceptance of it and we have taken payment as set out under the section ‘Payment’.

All prices displayed on this website are inclusive of VAT and duty rates that are valid at time of purchase. Some delivery charges may apply to the items you have ordered. These delivery charges will be outlined before checkout. You can also find out these costs on our Delivery & Returns Policy page.
Whilst we have taken all necessary precautions to ensure that all details, descriptions, and prices which appear in our store and online are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and provide you with the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. Where additional charges are made for delivery, they are clearly displayed.

Payment can be made by any of the methods specified in the payment section of this website and payment will be debited and cleared from your account when the order is created. You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.
We use Stripe for payment, analytics, and other business services. Stripe collects identifying information about the devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us, including for fraud detection. Goods must be ordered by and received by a person 18 years of age or older. Where any of our carriers’ drivers are in doubt as to the age of the person receiving the goods, they reserve the right to request proof of age and / or retain the goods until they can be received by a person of or above the legal age to purchase alcohol.
Cider Cellar will use the services of a courier company of its choosing in Ireland. The Cider Cellar website may or may not provide information to enable the tracking of your delivery.
Damaged & Defective Goods
In the event of receiving a damaged product, if the product is broken or has leaked, you can refuse to sign for it. Subsequently, if you open the parcel and find that the product is damaged or has leaked then you will need to provide evidence in the form of photographs. Customers must provide evidence within 24 hours of receipt of goods. After this period the product will become ineligible for a refund. Customers will need to contact and send evidence to our customer services team hello@cidercellar.ie who will assist in either issuing a full refund (including all shipping costs) or send out a replacement product.
Incorrect or Unwanted Goods
You, as our customer, have up to 7 days from receipt of your goods to return an unwanted product back to Cider Cellar. You will need to download and complete the returns form, and send it back to Cider Cellar.com along with the goods to return. You will be responsible for:
1) Not opening the container or removing any seals as part of the container
2) Keep intact any accessory or details associated to the container
3) Completing the returns form
4) Re-packing all containers as they were received.
5) All postage / shipping costs
If the unwanted or incorrect product received by Cider Cellar is of a satisfactory condition or the product you received is incorrect then Cider Cellar will, by your request:
1) Issue a full refund, within 7 working days, excluding all original delivery charges paid, unless you received an incorrect item, or
2) Send out the correct or a replacement product with the same delivery terms as the original order

The company shall be relieved of all or any of its obligations under the contract to the extent that performance of such obligations is prevented, frustrated, impeded or delayed in consequence of any statute regulation or order of any government or other authority of any strike, lock-out or trade dispute (whether involving the company’s employees or those of other parties) or any other cause whether or not of a like or similar nature beyond the company’s control.

We reserve the right to cancel/not accept an order if:
- We have insufficient stock to fulfil the order
- We do not deliver to your area
- One or more of the goods ordered was incorrectly described or priced on our website
- The payment transaction is not authorised
- You do not provide us with your real name, payment details including your card address, your delivery address (if different from your card address), email address and telephone number
- You are not 18 years of age or older.
- You have not completed the ID Verification at the time of your first order.

Customers are entirely responsible for all the activities that occur under their Cider Cellar online account. Should an issue occur, the customer agrees to notify us immediately of any unauthorised use or any other breach of security.
It is your responsibility to protect your user name and password information from being disclosed to any third party.

We always reserve the right to place advertisements and promotions on the website.
We will not share your details with a third party other than if obliged to do so in the course of fulfilling your order.

EU recognised allergens are listed on the product labels. The allergen indications in English may be in one of the following forms: In the case of sulphur dioxide: ‘sulphites’, ‘sulfites’, ‘sulphur dioxide’ or ‘sulfur dioxide’. It is your responsibility to inspect the packaging and identify whether the products contain allergens.

You cannot share links to protected resources in member areas, such as images and videos. Cider Cellar hereby declares that the content within its website and new media posts are copyright. We may close this website with or without notice at any time and with immediate effect. In addition, we, at our sole discretion, may close your account for violation of the letter or spirit of these terms and conditions without notice at any time and with immediate effect.

Every time you order Product(s) from us, the Terms in force at the time of your order will apply to the Contract between you and us.
We may revise these Terms as they apply to your order from time to time to reflect the following circumstances:
(a) changes in relevant laws and regulatory requirements; and/ or
(b) circumstances affecting us
It is your responsibility to verify if the these conditions of sale have changed and effect the our delivery to you.

OUR LIABILITY IF YOU ARE A CONSUMER
This clause only applies if you are a consumer.
If the Product(s) we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at hello@cidercellar.ie of the problem within 24 hours of the delivery to you of the Product(s) in question. We may ask you for evidence of the damaged or defected Product(s) to assess which party is responsible for the damage.
If you do not receive Product(s) ordered by you within 15 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address within 5 days of the date on which you ordered the Product(s).
If you notify us of non receipt of product , our only obligation will be, at your option
(a) to make good any shortage or non-delivery;
(b) to replace or repair any Product(s) that are damaged or defective; or
(c) to refund to you the amount paid by you for the Product(s) in question in whatever way we choose.
Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the Product(s) in question under these terms and conditions.
We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:
(a) loss or damage was not foreseeable to both parties when the contract was formed;
(b) loss or damage was not caused by any breach on the part of the supplier;
(c) loss or damage relates to business and/or non-consumers.
We do not in any way exclude or limit our liability for:
(a) death or personal injury caused by our negligence;
(b) fraud or fraudulent misrepresentation;
(c) defective Product(s) under the Consumer Protection Act 1987.
We only supply the Product(s) for domestic and private use. You agree not to use the Product(s) for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
Customers should also be aware of the following inherent risks and warnings relating to the Product(s):
(a) Alcohol should be consumed in moderation.
(b) The Product(s) supplied can be heavy so extra care should be taken when lifting them.
(c) Cider may cause staining if spilt so extra care should be taken.
(d) Sparkling ciders can be volatile due to the build-up of gasses extra care should be taken when opening these.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

By providing your details to us on our web site, you consent to us maintaining, recording, holding and using the information you give us at the time of ordering to process your orders, to improve our service to you and inform you of any promotions. All data is collected lawfully and maintained in accordance with prevailing GDPR regulations.
We take your privacy very seriously and will not pass your details to any third party without your permission, other than where we have to do so to get your Product(s) to you, e.g. our delivery company & ID verification.
We will use information about you to make marketing offers via email, based on your Product(s) preferences from time to time.
If you opt-out from hearing from us, you will only be contacted by us regarding service issues including, but not exclusively, order confirmation and delivery confirmation, significant changes to terms and conditions and informational, non-marketing emails.

You acknowledge and agree to be bound by the terms of our privacy policy as set out in this clause.

We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms. We will always notify you by posting on this webpage if this happens.
This Contract is between you and us. No other person shall have any rights to enforce any of its terms.
Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
If you are a consumer, please note that these Terms are governed by Irish law. This means a Contract for the purchase of Product(s) through our site and any dispute or claim arising out of or in connection with it will be governed by Irish law. You and we both agree to that the courts of the Republic of Ireland will have exclusive jurisdiction.
If you are a business, a Contract and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Ireland.
